Telangana High Court Challenges Merger of Municipalities with GHMC
The Telangana High Court has issued notices to the state government regarding the constitutional validity of three ordinances aimed at merging surrounding municipalities and local bodies with the Greater Hyderabad Municipal Corporation (GHMC). This decision came from a two-judge panel on March 6, 2024, which includes Chief Justice Aparesh Kumar Singh and Justice G. M. Mohiuddin. The court has granted the government a period of four weeks to respond to the writ petition challenging these ordinances.
The petition was filed by Barigala Raju, a resident of Tukkuguda municipality. Raju contended that there was no pressing need for the issuance of the ordinances concerning the mergers. He expressed concern over the manner in which the merger was executed, arguing that it undermines democratic representation and the autonomy of local self-government institutions.
Raju’s petition highlights several critical issues, asserting that the ordinances have significant implications for municipal governance and civic duties. Specifically, he claims that the ordinances facilitated mergers through legislative insertion and automatic inclusion, which bypassed necessary statutory safeguards. He believes the changes could lead to a concentration of power within the GHMC, potentially marginalising local voices in the decision-making process.
