Acid Attack Survivor Shaheen Malik Reels After Court Acquittal

A Delhi court’s recent decision to acquit the main accused in the acid attack on social activist and survivor Shaheen Malik has left her feeling disillusioned with the justice system. Sixteen years after the brutal assault in 2009, a Rohini court cleared three defendants and a juvenile of all charges related to the incident in Haryana. This verdict has not only impacted Malik’s faith in legal protections but also raises concerns for other survivors of gender-based violence.

Malik, now 42, was just 26 when she was attacked outside her workplace in Panipat, where she was pursuing an MBA and working as a student counsellor. The assault, which she attributes to jealousy and hostility from colleagues, left her face severely disfigured and resulted in the loss of vision in one eye. Over the years, she has undergone 25 reconstructive surgeries and extensive medical treatment.

Reflecting on the court’s ruling, Malik expressed profound disappointment. “I fought this case for 16 years believing that truth and persistence would matter,” she stated. “Today I feel defeated—not because I survived an acid attack, but because the system could not deliver justice.”

Impact on Survivors and Advocacy Work

Malik’s anguish extends beyond her own experience; she fears the acquittal will deter other survivors from seeking justice. For the past decade, she has been an advocate for acid attack survivors, founding the Brave Souls Foundation in 2021 and establishing a shelter home called Apna Ghar. Her foundation has supported over 300 survivors in accessing medical care, counselling, and vocational training.

“The survivors look at me and ask, ‘If you could not get justice, what hope do we have?’” Malik shared. This sentiment underscores her concern that the court’s decision may lead victims to silence or compromise, believing that their struggles will yield no results. “This judgement risks telling victims that seeking justice is not worth it,” she added.

Despite her personal challenges, Malik’s tenacity shines through. Raised in a conservative family in Delhi, she defied societal expectations by pursuing higher education and a career. “I lost an eye, but I did not lose my courage,” she remarked. Yet, the recent court ruling feels like a significant blow to her spirit.

Next Steps and Ongoing Challenges

In light of the verdict, Malik plans to challenge the acquittal in a higher court. “I will appeal,” she stated, though she acknowledged uncertainty about the outcome. Her voice trembled as she addressed the broader implications of the ruling: “For acid attack survivors, for rape survivors—what does this system really offer them?”

Malik’s discontent also stems from what she perceives as a lack of sensitivity within institutions that are supposed to protect victims. “People who have never lived this pain are making decisions that define our lives,” she asserted.

For a woman who has transformed her trauma into a mission of support, the court’s decision has reopened wounds and cast doubt on her advocacy work. “This case did not defeat me because I lost,” she said quietly. “It defeated me because the system failed.”

As she prepares for another legal battle, Malik embodies resilience but grapples with disappointment. “I survived acid,” she concluded. “I did not expect to survive this much disappointment from the justice system.”
