Government Defends High Court Judges’ Transfers in Lok Sabha
The Indian government reaffirmed that all transfers of high court judges are conducted in the public interest, emphasizing the need for effective judicial administration. This statement came during a session in the Lok Sabha on February 13, 2024, where Law Minister Arjun Ram Meghwal addressed concerns regarding alleged executive interference in the transfer process.
In his written reply, Meghwal clarified that the transfer of judges is not arbitrary but follows a structured procedure designed to enhance the administration of justice across the nation. The Minister responded to inquiries about recent claims of government involvement in such transfers, highlighting the importance of maintaining judicial independence.
The transfer process for high court judges is governed by the Memorandum of Procedure (MoP), which outlines the roles of various authorities involved. According to Meghwal, the initiative for a transfer originates with the Chief Justice of India (CJI), who consults with the four senior-most judges of the Supreme Court. This collaborative approach is intended to ensure that transfers are made based on comprehensive evaluations.
Meghwal elaborated that the CJI must consider the opinions of the Chief Justice of the high court from which the judge is being transferred, as well as the Chief Justice of the receiving high court. Additionally, input from other Supreme Court judges who may provide relevant perspectives is factored into the decision-making process.
Personal circumstances related to the judge, including their preferences for placement, are also a critical consideration in the final decision. This comprehensive approach aims to balance judicial needs with individual circumstances, ensuring that transfers serve both the judiciary and the public effectively.
The issue of executive interference gained attention following a notable incident in October 2023. The Supreme Court Collegium had altered its earlier decision regarding the transfer of Justice Atul Sreedharan from the Madhya Pradesh High Court to the Allahabad High Court, citing a request for reconsideration from the government. This situation has raised questions about the balance of power and the autonomy of the judiciary in India.
The government’s response in the Lok Sabha aims to reassure the public that the process is transparent and oriented towards serving the interests of justice, rather than political motives. As discussions around judicial transfers continue, the emphasis on procedure and consultation highlights the government’s commitment to uphold the integrity of the judicial system while addressing operational needs.
