Maharashtra Chief Minister Calls for Central Law on Online Gaming

Maharashtra Chief Minister Devendra Fadnavis has stated that only the Central government can take effective measures against online gaming, as state governments lack the authority to regulate the sector. Speaking during a Calling Attention Motion in the Maharashtra Assembly on July 18, 2023, Fadnavis emphasized that the current legal framework governing online gaming falls under the jurisdiction of the Centre, specifically the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Fadnavis’s remarks came in response to concerns raised by several legislators about the impact of online gaming on the youth, particularly in regions like Dharashiv. Kailas Ghadge Patil, a member of the Shiv Sena (UBT), highlighted the issue of young people spending excessive amounts on online games and questioned why Maharashtra had not implemented a ban similar to that of Telangana, which has enforced a complete prohibition on online gaming.
In addressing these concerns, Fadnavis pointed out that states attempting to regulate online gaming independently have struggled to enforce effective measures. He remarked, “What action will a state like Telangana take on users indulging in online gaming on the internet? States cannot take action on every single user playing online games.” His comments reflect a broader recognition of the challenges associated with regulating a digital landscape that transcends state borders.
The Chief Minister further noted that states such as Telangana and Andhra Pradesh, which have sought to ban online gaming platforms, have not succeeded in curbing participation, as many games continue to be accessible online. “If the hosting doesn’t stop, then what’s the point of a state-level ban?” he questioned, underscoring the limitations of local regulations in a global internet environment.
Fadnavis confirmed that he has communicated with the Central government regarding the need for cohesive legislation on online gaming. “I have written to the central government about the issue and have personally discussed the matter with the IT Minister,” he stated. He expressed optimism that the Central government would take action to create comprehensive laws addressing the challenges posed by online gaming.
In addition to the regulatory discussions, some members of the Maharashtra Assembly are advocating for a ban on advertisements for online gaming platforms. Although the government has not yet initiated legal measures in this regard, Fadnavis has called on public figures and celebrities to voluntarily refrain from endorsing online gaming products.
As the debate over online gaming regulation continues, the Maharashtra government is poised to push for a centralized approach, aiming to establish effective frameworks that address both the legal and social implications of this rapidly growing industry.
