A federal judge has ordered immigration officials to immediately release Kilmar Abrego Garcia, a man wrongfully deported from the United States who returned and is currently facing criminal charges. The ruling, issued on October 19, 2023, by US District Judge Paula Xinis, comes after Garcia’s contentious history with immigration enforcement, particularly under the previous administration.

Judge Xinis found that Garcia’s detention by US Immigration and Customs Enforcement (ICE) was unlawful, as he had been held without a valid removal order. In her 31-page opinion, she stated that his prolonged detention was not justified, emphasizing that it was not aimed at facilitating a lawful removal. “Because Abrego Garcia has been held in ICE detention to effectuate third-country removal absent a lawful removal order, his requested relief is proper,” she wrote.

The judge’s decision is a significant victory for Garcia, who has been seeking his release from custody for months. Following his wrongful deportation to El Salvador in March 2023, Garcia returned to the US in June 2023 after a Justice Department indictment in a human smuggling case was unsealed in Tennessee. He pleaded not guilty to the charges and was briefly released on conditions pending trial.

“Respondents’ persistent refusal to acknowledge Costa Rica as a viable removal option, their threats to send Abrego Garcia to African countries that never agreed to take him, and their misrepresentation to the Court that Liberia is now the only country available to Abrego Garcia, all reflect that whatever purpose was behind his detention, it was not for the ‘basic purpose’ of timely third-country removal,” Judge Xinis wrote.
