Delhi High Court Orders Response in Karisma Kapoor Will Dispute

The Delhi High Court has requested a response from Priya Kapur, the wife of the late Sunjay Kapur, following allegations by his children regarding the authenticity of an alleged will. Karisma Kapoor’s children, Samaira Kapur and her brother, filed a plea claiming that the will is “forged and fabricated.” This legal battle centers on the distribution of Sunjay Kapur’s assets, valued at approximately Rs 30,000 crore.

The court’s order came after the children sought to inspect the original copy of their father’s will. Joint Registrar (Judicial) Gagandeep Jindal has issued notices to both Priya Kapur and Shradha Suri Marwah, the named executor of the will. Each party has been granted three weeks to respond, with a follow-up hearing scheduled for December 16, 2023.

In their application, the children assert that the signatures on the will do not match their father’s and accuse Priya Kapur of collusion with the witnesses to create the document. Priya Kapur has firmly denied these allegations, with her legal counsel describing the children’s earlier claims as “bogus and baseless.” During a previous court session, her lawyer argued against the notion that the will could be dismissed as fake due to minor spelling errors, noting that the authenticity of Sunjay Kapur’s signature had not previously been contested.

As part of their latest legal maneuver, Sunjay Kapur’s children have underscored the necessity of examining the original will, which was submitted to the court in a sealed envelope by executor Shradha Suri Marwah on September 25, 2023. Their plea emphasizes that access to the original document is critical for evaluating its legitimacy, stating, “Inspection of the original copy of the alleged will is inter alia necessary for the plaintiffs to take appropriate steps regarding the genuineness of the said document.”

This dispute highlights the complexities surrounding inheritance and the potential for familial conflicts over significant assets. The upcoming court hearings are anticipated to further illuminate the details surrounding the will and its implications for all parties involved.
