The Pentagon has introduced a new policy that significantly limits the ability of transgender troops to contest their separation from the military, according to a memo obtained by The Associated Press. This directive follows the previous ban on transgender service members established during the Trump administration and aims to further restrict their rights within the armed forces.

Under the new policy, which was communicated to military branches in a memo dated October 8, commanders have the authority to override decisions made by military separation boards that might allow transgender personnel to remain in service. This change breaks from a long-standing practice where such boards operated independently. The memo was made accessible to troops only last week, raising concerns among advocates for transgender rights.

The new guidelines require that transgender service members appear before separation boards in uniforms that correspond with the gender assigned to them at birth. If they fail to comply, their absence may be counted against them during proceedings. Emily Starbuck Gerson, a representative of SPARTA Pride, an advocacy group for transgender military personnel, described the uniform mandate as an additional obstacle that could prevent many from attending their hearings. “They’re already essentially being rigged with a predetermined outcome, and now you’re further penalizing someone for not showing up because they can’t wear the wrong uniform,” Gerson stated.

In August, a prior Air Force directive indicated that separation boards could not independently decide on the retention of transgender troops but were instead mandated to recommend separation if a member had a diagnosis of gender dysphoria. Gerson noted that the latest policy mirrors earlier Air Force guidelines but introduces more stringent requirements.

The October memo states that if a service member does not adhere to uniform and grooming standards, the board proceedings will continue without them, potentially impacting the outcome of their case. Many transgender troops, who have been serving for years, may not have uniforms that align with their assigned gender at birth, resulting in feelings of alienation and identity conflict.

Logan Ireland, a master sergeant in the Air Force with 15 years of service, expressed his concerns about the implications of the policy. He noted that being forced to wear a uniform that does not reflect his identity would be a betrayal of how he has been recognized in service. “It would be like a costume-like effect,” he remarked.

The recent policy shifts raise significant questions about fairness and due process within military separation procedures. Traditionally, these boards offer service members a chance to present their case for continued service in a quasi-legal setting. They are allowed to present evidence and appeal decisions made by the boards.

Priya Rashid, a military lawyer experienced in separation cases, highlighted the disparity in protective measures afforded to different service members. “Service members accused of serious misconduct are being afforded more due process protections than this group of people solely based on the administrative label of gender dysphoria,” Rashid said.

The Pentagon’s new approach follows ongoing legal challenges against the bans on transgender service members. Despite pushback from various advocacy groups, the U.S. Supreme Court permitted the enforcement of the ban while legal disputes continue.
