A South Korean woman, Choi Mal-ja, has been acquitted of charges stemming from an incident that occurred over six decades ago in which she partially bit off the tongue of an attempted rapist. The Busan District Court ruled on Wednesday that her actions were justifiable as self-defense, a significant decision considering her initial conviction in 1964.

At the age of just 18, Choi faced a legal battle after the attempted assault. She was sentenced to ten months in prison, which was suspended for two years, for her actions against a man who had tried to rape her. The perpetrator, however, received only a six-month suspended sentence for charges of trespassing and blackmail. This disparity in justice left a lasting impact on Choi.

In recent years, Choi sought to clear her name by appealing her conviction. In 2020, she filed for a retrial, arguing that her actions were in self-defense. The Supreme Court of South Korea agreed to her appeal in 2023, acknowledging the need to revisit the case. During the retrial, prosecutors expressed remorse for the suffering Choi endured and requested her acquittal.

In a statement following the court’s decision, Choi reflected on the challenges she faced in pursuing justice. “Those around me tried to dissuade me, saying it would be like hitting a rock with an egg, but I couldn’t bury the case,” she stated. “I had to take the lead for victims who shared the same fate as myself, and I wanted to be their hope.”

Choi’s case has garnered significant attention as it highlights issues surrounding self-defense laws and the treatment of victims in the legal system. Her acquittal marks a turning point, not only for her but also for others who have faced similar injustices.

The Busan District Court’s decision underscores the evolving understanding of self-defense, especially in cases involving sexual violence. As society continues to grapple with these complex issues, Choi Mal-ja stands as a testament to resilience and the pursuit of justice, even after many years have passed.
