Supreme Court Challenges Government on Execution Methods

The Supreme Court of India has expressed dissatisfaction with the central government’s refusal to consider alternatives to hanging as a method of execution. During a recent hearing, the court addressed a public interest litigation (PIL) advocating for the replacement of hanging with methods such as lethal injection. The bench, consisting of Justices Vikram Nath and Sandeep Mehta, highlighted the government’s reluctance to adopt modern practices.

Justice Mehta articulated his concerns, stating, “The problem is, the government is not ready to evolve…it’s a very old procedure; things have changed over a period of time.” This remark underscores the court’s view that execution methods should align with contemporary standards.

The PIL, filed by Advocate Rishi Malhotra, argues for the adoption of lethal injection, which is utilized in 49 US states. Malhotra described hanging as “cruel, barbaric, and lingering,” advocating instead for methods that would result in quicker executions. The petitioner also seeks to establish the right to a dignified death as a fundamental right, referring to Article 21 of the Indian Constitution. This argument posits that current execution methods violate this right and contravene United Nations resolutions aimed at minimizing suffering during capital punishment.

In a previous session in March 2023, the Supreme Court contemplated the formation of an expert committee to examine the implications of hanging, including the pain inflicted and the duration of the execution process. Following this, Attorney General R. Venkataramani suggested that a committee could explore more humane alternatives to execution.

The Supreme Court has now adjourned the matter until November 11, 2023, for further hearings. As discussions continue, the outcome may significantly impact the future of capital punishment practices in India, raising essential questions about human rights and the ethics of execution methods.
