Supreme Court Rules Insurers Must Compensate Accident Victims
The Supreme Court of India has ruled that insurance companies cannot deny compensation to accident victims based solely on deviations from the permitted route of the vehicle involved. This decision reinforces the principle that insurance policies should protect vehicle owners and operators from liability in unforeseen accidents, even if they occur outside the scope of a permit.
A bench comprising Justices Sanjay Karol and Prashant Kumar Mishra emphasized that denying compensation to victims or their dependents simply because an accident occurred beyond the contractual limits would violate fundamental principles of justice. The court stated, “To deny the victim/dependents of the victim compensation simply because the accident took place outside the bounds of the permit… would be offensive to the sense of justice.”
This ruling emerged from a case involving a motorcyclist who tragically lost his life on October 7, 2014, after being struck by a vehicle driven recklessly. The Motor Accident Claims Tribunal awarded a compensation amount of Rs 18.86 lakh along with interest to the victim’s family.
The vehicle owner and the insurer, The New India Insurance Company Limited, contested the Tribunal’s decision in the Karnataka High Court, arguing that the compensation awarded was inaccurate and that the accident violated the policy’s conditions. However, the High Court upheld the Tribunal’s ruling, directing the insurance company to fulfill the compensation payment while allowing it the right to recover the amount from the vehicle owner later.
The insurer’s appeal against this directive focused on the obligation to pay compensation upfront, while the vehicle owner challenged the High Court’s order permitting recovery from him. Ultimately, the Supreme Court dismissed these appeals and reaffirmed the need for insurance companies to honor their commitments to accident victims, regardless of route deviations.
This decision underscores the importance of protecting accident victims and highlights the court’s commitment to ensuring justice in cases where unforeseen incidents occur, reflecting a broader understanding of the role of insurance in society.
