SCBA President Criticizes Social Media After Shoe Attack on CJI Gavai

The President of the Supreme Court Bar Association (SCBA), Vikas Singh, has publicly condemned the role of social media in escalating tensions surrounding a recent incident involving Chief Justice of India (CJI) BR Gavai. This statement follows an attempt by advocate Rakesh Kishore to throw a shoe at the CJI during court proceedings on March 18, 2024. Singh attributed this extreme reaction to the misrepresentation of the CJI’s remarks regarding a case related to the Javari Temple in Khajuraho, Madhya Pradesh.

In comments made to ANI, Singh expressed concern that social media distorted the CJI’s words, creating a false narrative. He noted that the remarks made during a public interest litigation (PIL) were intended to guide the petitioner, suggesting that any restoration of a damaged idol would fall under the jurisdiction of the Archaeological Survey of India (ASI). Singh emphasized, “The CJI rightly said that these are matters for the authorities to consider, because there are ASI issues if it is an archaeological structure and religious issues as well. So, accordingly, the petition was dismissed.”

Singh criticized the online portrayal of the CJI’s comments, which led to Kishore’s aggressive actions. “That statement was misrepresented by social media to give an impression as if the CJI had insulted the deity,” he remarked. He further described Kishore’s behavior as an attempt to gain publicity, urging both traditional media and social platforms to refrain from amplifying his actions, as it appeared to be a deliberate act for attention.

Despite the CJI opting not to pursue legal action against Kishore, Singh underscored the responsibility of the SCBA and the Bar Council of India to uphold the dignity of the legal profession. He stated, “Even if the CJI feels that no action needs to be taken and he has shown a large heart, I think we as the Bar Association owe a duty to the institution and the Bar Council of India owes a duty to the profession.” The SCBA plans to deliberate on the incident in an upcoming executive committee meeting to determine appropriate actions.

The shoe-throwing incident unfolded during court hours on Monday when 71-year-old advocate Kishore attempted to assault CJI Gavai. Security personnel quickly apprehended him, and he was subsequently handed over to Delhi Police for questioning. Kishore reportedly expressed frustration over the dismissal of his plea concerning the restoration of a beheaded idol of Lord Vishnu at the Javari temple. During the hearing, CJI Gavai advised the petitioner, “Go and pray to Lord Vishnu,” indicating that the matter was beyond the court’s jurisdiction.

The incident has provoked strong reactions within the legal community, with many calling for disciplinary measures against Kishore. Following three hours of questioning, he was released, but the SCBA is set to discuss possible responses during its next executive committee meeting. The event highlights the growing concern regarding the impact of social media on public discourse and the potential consequences for individuals in the legal profession.
