Supreme Court to Address Stray Dog Relocation in Delhi-NCR

The Supreme Court of India has referred the contentious issue of relocating stray dogs in the Delhi-NCR region to a three-judge bench. The case, initially brought to light on August 11, 2023, by a two-judge bench, had ordered the relocation of stray dogs to shelters within a timeframe of six to eight weeks. The latest hearing is scheduled for tomorrow.

The new bench, which includes Justices Vikram Nath, Sandeep Mehta, and NV Anjaria, will review the earlier directive that has sparked widespread protests among animal advocates in the capital. These advocates are expressing significant concern over the order, which they argue undermines the welfare of community dogs.

Earlier today, Chief Justice BR Gavai acknowledged the need to reassess the Supreme Court’s directive regarding the removal of stray dogs from the streets. A lawyer involved in the case raised alarms about the implications of this order, citing a prior Supreme Court judgment that prohibits the indiscriminate killing of dogs. The lawyer emphasized the importance of compassion towards all living beings, stating, “This concerns community dogs… There is a prior judgment of this court, in which Justice Karol was part of the bench, stating that there cannot be indiscriminate killing of canines and that compassion for all living beings is essential.”

In response to these concerns, Chief Justice Gavai noted the existence of the prior orders issued by another bench. He stated, “But another bench has already passed orders. I will look into this,” as reported by LiveLaw.

The issue of stray dogs has become increasingly contentious in urban India, where many residents and animal rights activists argue for humane alternatives to relocation. These advocates insist that the focus should be on responsible management of stray populations rather than removal, which can lead to further suffering for the animals involved.
