Kerala High Court Confirms State’s Ban on Single-Use Plastics

The Kerala High Court has upheld a significant ban on single-use plastic items, reaffirming the State government’s 2019 decision to prohibit the manufacture, storage, transport, and sale of such products across the state. This ruling, delivered by a bench led by Justice Viju Abraham, confirms that the ban has been in effect since January 1, 2020.

The court dismissed petitions from the Kerala Plastic Manufacturers’ Association, which challenged the legality of the ban. The items affected by this ruling include various plastic carry bags, single-use utensils such as cups and plates, plastic sheets, and certain types of bottles, as well as non-woven bags. The petitioners argued that the state lacked the authority to enforce the ban without corresponding rules from the central government.

In response, the state contended that the ban was implemented under the Environment Protection Act, a legislative power previously upheld by the Supreme Court. This argument underscored the state’s commitment to addressing environmental challenges and reducing plastic pollution.

The High Court also addressed challenges regarding fines levied against manufacturers for illegal activities related to single-use plastics. The court stated, “It is for the petitioners to work out their remedy in appropriate proceedings.” This indicates that the manufacturers must seek legal recourse through the proper channels if they wish to contest the penalties imposed on them.

The ruling emphasizes the government’s responsibility to enforce the directives outlined in both state orders and central regulations. By supporting the ban, the Kerala High Court highlights the growing global trend towards reducing plastic waste and promoting sustainable practices.
