Man’s Will Grants 4 Hectares of Land to Friend After 10 Years
A friendship solidified by a legal document has resulted in a significant land transfer in Ahmedabad, India. A civil court recently affirmed the will of Navin Patel, who passed away on June 27, 2014, leaving over four hectares of non-agricultural land to his long-time friend, Girish Patel. The will, executed on May 22, 2014, took nearly a decade to reach the courtroom due to Girish’s frequent travels abroad.
The land in question, approximately 40,369 square meters located in Paldi-Kankaj village within Daskroi taluka, is valued in the crores. Despite the lengthy delay, Girish was able to secure probate after presenting the will to the Ahmedabad rural court this year. He explained the postponement by noting his international commitments, which hindered his ability to initiate legal proceedings sooner.
During the court proceedings, Girish asserted that Navin was “of sound mind and fully capable of making the will” and that it was created “without any fraud or coercion.” The will explicitly designated the land to Girish, alongside other movable and immovable properties allocated to Navin’s legal heirs.
As part of the probate process, a public notice was published in November 2024, inviting any objections. Neither Navin’s legal heirs nor any third parties contested the will. Furthermore, one of the attesting witnesses, Mukund Panara, provided an affidavit affirming the will’s authenticity, further supporting Girish’s claim.
After reviewing the evidence, G T Solanki, an additional senior civil judge, concluded that Girish, along with the other legal heirs, was entitled to receive the probate certificate for the properties listed in the will. The court’s decision specifically allows Girish to proceed with distributing both the movable and immovable properties as per Navin’s wishes.
This case highlights the importance of wills in defining property rights and relationships, showcasing how a thoughtful gesture can endure the test of time and legal scrutiny.
